Lifetime Limited Warranty

WARRANTY COVERAGE & TERM.
This warranty is issued by Pentel of America, Ltd. (“POA”) and applies to all products manufactured and distributed by POA, including those under other brand names (collectively referred to herein as “POA Product(s)) except for those expressly excluded below. Each POA Product is warranted against failure due to defects in materials and workmanship for as long as you own the POA Product. This lifetime limited warranty begins on the day you purchase the POA Product and applies to the original owner of the product or any subsequent owners of the POA Product.

WHAT WE WILL DO.
In the event your POA Product experiences a failure due to a defect in materials and/or workmanship, POA will repair or replace the POA Product for no charge. In the event of discontinued POA Products, we will replace your POA Product with a POA Product of like kind and quality or return your POA Product to you at your option.

HOW TO MAKE A CLAIM.
To initiate a claim under this lifetime limited warranty, contact POA at (855) 528-4101 or visit www.pentel.com/contact-us. To complete a repair or replacement, you will be required to return your POA Product to: Pentel of America, Ltd., 4000 E. Airport Drive, Suite C, Ontario, California, 91761, U.S.A., Attn: Quality Assurance Department, (855) 528-4101. When returning your POA Product(s), we recommend the use of a padded envelope or a similar packaging method. Damage or loss in transit is the end user’s responsibility and may be cause to void the warranty claim. Please note that not all Pentel-branded products are manufactured and distributed by POA and may be manufactured by one of POA’s international affiliates and distributed through other channels. For claims relating to Pentel-branded products that POA does not distribute, POA reserves the rights to contact or forward the claim to the original manufacturer.

EXCLUSIONS AND LIMITATIONS.
This lifetime limited warranty is only valid for Pentel-branded products that are manufactured and distributed by POA and purchased in the United States and does not apply to consumables, such as ink, ink refills, lead, and erasers. This lifetime limited warranty does not cover failure due to misuse, abuse, accident, normal or excessive wear and tear, theft, negligence, and/or impact.

ANY IMPLIED WARRANTIES, SUCH AS THE WARRANTY OF MERCHANTIBILITY AND THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANT LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. POA IS NOT LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSIONS OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
